TERMS AND CONDITIONS OF USE OF FIBIO

1. Acceptance of Terms

Welcome to Fibio. These Terms constitute a binding legal contract between you and Fibio App (Based in Code).

By downloading, installing, or using Fibio, you accept these Terms. If you do not agree, do not use the application.

These Terms apply to all users, both free version and Premium services.

2. Service Description

Fibio is a mobile application for managing personal finances. It allows you to record income and expenses, create budgets, set savings goals, and receive financial education through gamification.

The app includes a virtual mascot (piggy) that guides and motivates you. It operates under a hybrid model: local storage on your device or cloud synchronization.

3. We Are NOT Financial Advice

Fibio is NOT a financial institution, bank, or certified financial advisor.

All content is informative, educational, and entertainment: statistics, charts, predictions, mascot advice, and notifications.

We do not guarantee financial results. We do not promise you will save specific amounts or improve your financial situation.

You are solely responsible for your financial decisions. Any action based on Fibio information is at your own risk.

For professional advice, consult with a certified financial advisor or qualified accountant.

4. Requirements to Use Fibio

Minimum Age: 13 years. Between 13-18 years requires parental permission and supervision.

Compatible Device: iOS or Android according to App Store and Google Play specifications.

Internet Connection: Required for cloud synchronization, updates, and Premium features.

Valid Account: Required for Premium services, providing accurate and complete information.

5. Usage Modes

5.1. Free Mode (Local)

All your data is stored locally on your device (SQLite). Fibio does not have access to your specific financial data.

Important: You are responsible for creating backups. If you lose your device without backup, your data is permanently lost with no possibility of recovery.

5.2. Premium Mode (Cloud)

When activating Premium services or cloud synchronization:

Data License: You grant Fibio a license to host, store, process, and transmit your encrypted data for the purpose of providing the service.

Synchronization: Access your data from multiple devices.

5.3. Use of Aggregated Data

You authorize Fibio to use anonymized and aggregated data (impossible to trace to you) for internal purposes:

• AI training for categorization and predictions
• Statistical analysis of financial behavior
• User experience improvement and feature development

We do not share this data with third parties. Analyses remain completely internal.

6. User Accounts

Accurate Information: Provide true and updated information.

Confidentiality: Keep your credentials secure. Do not share them.

Personal Use: Your account is non-transferable.

Responsibility: You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized use.

Suspension: We may suspend accounts that violate these Terms or represent security risks.

7. Payments and Subscriptions

7.1. Processing

Apple App Store or Google Play Store process all payments. Fibio does not store or have access to your complete banking data.

7.2. Automatic Renewal

Premium subscriptions renew automatically. To cancel, do so at least 24 hours before the end of the period through your App Store or Google Play account.

After canceling, you maintain access until the end of the paid period. There are no prorated refunds.

7.3. Price Changes

We may modify prices with prior notice according to store policies. Existing subscribers generally maintain their current price for at least one additional cycle.

7.4. Refunds

Refund requests are subject to App Store or Google Play policies. They have final authority over approvals.

Fibio may consider refunds in exceptional circumstances on a case-by-case basis.

7.5. Free Trials

If you do not cancel before the trial ends, you will be automatically charged. Trials are limited to one per user.

8. Intellectual Property

8.1. Ownership

The application, source code, visual design, interfaces, and especially the "Fibio" mascot (the piggy) are exclusive property of Fibio App (Based in Code).

Protected by copyright, trademark, and trade secret laws.

8.2. Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use Fibio on your device solely for personal and non-commercial purposes.

8.3. Prohibitions

You may not:

• Reverse engineer or extract source code
• Modify or create derivative works
• Distribute, sell, or sublicense the application
• Use the "Fibio" brand or mascot without written consent
• Use Fibio for illegal or fraudulent purposes
• Use bots or automated tools to extract data
• Overload our infrastructure

8.4. Reporting Violations

If you detect violations of our rights, notify us immediately.

9. Gamification and Virtual Goods

Nature: The app includes virtual coins, points, achievements, and badges ("Virtual Goods").

No Real Value: They have no monetary value. They cannot be redeemed for money or sold.

License, Not Ownership: You only receive a usage license while your account is active.

Modification: We may modify or eliminate the Virtual Goods system at any time without compensation.

Prohibition: You may not buy, sell, or trade Virtual Goods on external platforms.

Loss: If your account is suspended or deleted, you lose all accumulated Virtual Goods.

10. User-Generated Content

Responsibility: You are responsible for any content you post or share.

License: By sharing content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display it for the purpose of operating the service.

Prohibited Content: Do not post illegal, offensive, defamatory content, or content that infringes third-party rights.

Moderation: We may review, edit, or remove inappropriate content without prior notice.

11. Updates and Availability

Updates: Some are optional, others mandatory for security.

Availability: We do not guarantee 100% uninterrupted availability.

Maintenance: We may perform maintenance that temporarily interrupts certain features.

"As Is": Fibio is provided "as is" and "as available". We do not guarantee error-free operation.

Modification: We may modify, suspend, or discontinue features at any time.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIBIO SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Data loss if you did not maintain backups
• Financial losses from decisions based on Fibio information
• Unauthorized use of your account (except our gross negligence)
• Malfunction or incompatibility with your device

Maximum Amount: Our total liability shall not exceed what you have paid us in the last 12 months, or $100 USD, whichever is less.

13. Indemnification

You agree to indemnify Fibio and Based in Code against any claim related to:

• Your use or misuse of the application
• Your violation of these Terms
• Your violation of third-party rights
• Content you post
• Fraudulent or illegal activities through your account

14. Modifications to Terms

We may modify these Terms at any time.

Notification: We will post changes in the app, send notifications, and for material changes may require explicit acceptance.

Recommended Review: Review these Terms periodically. Continued use constitutes acceptance of changes.

Right to Reject: If you disagree, stop using Fibio and delete the application.

15. Termination

15.1. By You

Uninstall the application at any time. If you have a Premium subscription, cancel it through App Store or Google Play.

15.2. By Us

We may suspend or terminate your access if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• You attempt to hack or compromise security
• You do not pay subscriptions
• Your account remains inactive for more than 2 years

15.3. Effects

Upon terminating your account:

• You lose access to Premium and cloud features
• Your data on servers is deleted according to Privacy Policy
• You lose all Virtual Goods
• Licenses are revoked
• Active subscriptions are non-refundable

16. Applicable Law and Disputes

Applicable Law: Laws of Ecuador.

Jurisdiction: Competent courts of Ecuador.

Waiver of Class Actions: Disputes are resolved individually.

Negotiation: Before legal proceedings, both parties will attempt to resolve disputes in good faith for at least 30 days.

17. General Provisions

Entire Agreement: These Terms and the Privacy Policy constitute the complete agreement.

Severability: If any provision is invalid, it is modified or eliminated without affecting the rest.

No Waiver: Not exercising a right does not constitute a waiver.

Assignment: You may not assign these Terms. We may assign them to affiliates or successors.
